This is not a dispute about old bricks. Bricks are innocent. They do not hire counsel, request consulting status, circulate objections, or discover that a proposed arch has injured their procedural dignity. The dispute now moving through Washington concerns something far more sacred to the custodians of delay: whether the present must ask permission from a committee before it is allowed to become history.
The Advisory Council on Historic Preservation is considering a rewrite of the regulations that govern Section 106 review under the National Historic Preservation Act. Current reporting says council members were asked to vote on proposed changes by July 24. The council itself began reviewing the regulations earlier this year and approved a schedule in June for developing revisions. The stated concerns are familiar and accurate: uncertainty, delay, and regulatory burden.
Those words have caused panic because they penetrate the defenses around a Washington sacrament. Section 106 is presented as memory protecting itself. In practice, it can become memory selecting its supervisors, multiplying its witnesses, and placing the elected executive under the custody of people whose authority expands every time a meeting is postponed.
Preservation
Public vocabulary: responsible stewardship of historic places. Operational meaning: the claim that yesterday holds a permanent lien on tomorrow.
President Trump wants to alter the physical face of Washington, including with a proposed monumental arch near Arlington Memorial Bridge. Critics object to the scale, the speed, the taste, the process, and the President. They are entitled to object. They are not entitled to convert objection into ownership. A capital that cannot be touched by the government chosen to govern it is not preserved. It is repossessed.
Every generation that built official Washington changed what the next generation would call historic. Stone was cut. Roads were moved. Vistas were imposed. Buildings rose where earlier citizens had known mud, pasture, shops, homes, and other buildings. The city did not descend intact from a preservation conference. It was built by men willing to leave marks large enough for later committees to regulate.
Consultation
Public vocabulary: listening before acting. Operational meaning: distributing enough permission slips that no one can identify the person who said no.
Section 106 does not require every critic to prevail, but consultation acquires its own momentum. State preservation officers, tribal authorities, local governments, organizations, experts, and members of the public may all have legitimate knowledge. Knowledge should inform a decision. Washington’s trick is to make information indistinguishable from command, then describe the resulting paralysis as care.
The proposed rewrite has drawn warnings that it would shift more control to federal agencies and narrow the role of outside consultation. Good. Federal agencies should be answerable for federal decisions. If an agency damages a historic property, name the agency, name the official, show the damage, and demand accountability. Do not hide responsibility inside a procession of meetings where every participant possesses influence and nobody possesses the deed.
Adverse Effect
Public vocabulary: a change that may diminish historic character. Operational meaning: any footprint left by a living government on ground claimed by professional memory.
The phrase is powerful because it sounds clinical while carrying a political choice. A new building can affect a view. An arch can affect a landscape. A renovation can affect original material. These are facts suitable for drawings, measurements, hearings, and judgment. But effect is not desecration, and historic character is not a restraining order against ambition.
Trump’s opponents understand this better than they admit. They do not merely dislike an arch. They dislike the possibility that Trump could place a durable object into the national frame, an object future schoolchildren might see without first passing through today’s editorial desk. The anxiety is not that history will be erased. The anxiety is that Trump will enter it in stone too large for a caption writer to domesticate.
Independent
Public vocabulary: insulated from political pressure. Operational meaning: political power that has misplaced the return address.
The preservation council is an independent federal agency, yet its membership and authority exist within constitutional government. Its members are not a hereditary order of national memory. If a council shaped in significant part by Trump appointees decides that executive agencies should exercise clearer control over review, that is not history surrendering to politics. It is politics becoming visible inside a process that was political before Trump arrived.
The critics call this capture because the President’s influence has reached an institution designed to influence presidential action. They prefer domination when it travels in the other direction. An advisory body may discipline an administration through delay and call the arrangement neutral. An administration may revise the terms of that discipline and suddenly every locked archive begins screaming about power.
History
Public vocabulary: what must be protected from us. Operational meaning: what they intend to use against us while denying that anyone is using it.
A serious government should document what it changes, preserve records, consult people with relevant knowledge, obey the statute, and explain its decisions. It should not be trained to confuse endurance with legitimacy. Some old things are beautiful. Some old systems are merely old. Some procedures preserve landmarks. Others preserve the authority of the last person who learned how to extend the deadline.
The council has not completed the rewrite. A vote on whether to move the proposal forward is expected by Friday, and any proposed rule would still face additional review. That sequence matters. This is not a finished decree. It is a test of whether the executive branch may recover responsibility from a ritual that has learned to survive by making responsibility impossible to locate.
Watch the verb after the vote. If the press says Trump is weakening review, ask what review was strong enough to do and too unaccountable to admit. If officials say they are streamlining consultation, ask which participant no longer holds a silent veto. If opponents say the future of history is endangered, look at the drawings they are desperate to prevent from becoming stone.
